Limited Liability Waiver & Assumption of Risk
For voluntary use of Accurate Athlete’s unmanned studio, Styku body scans, Demotu movement assessments, and related assessment services.
1. Unmanned studio and voluntary participation
Accurate Athlete, LLC operates an unmanned studio in Vancouver, Washington. There is no continuously present on-site staff member, trainer, medical professional, or safety monitor. Staff may not be available to provide immediate assistance.
I voluntarily choose to use the studio and services offered to me, including Styku 3D body scanning, Demotu movement or gait assessment, and related digital assessment tools. Participation is voluntary, and I may stop an activity at any time.
2. Risks
I understand that standing, turning, following movement instructions, and taking part in a physical assessment can involve risks. These may include slips, trips, falls, muscle strains, sprains, discomfort, imbalance, an adverse physical reaction, or injury related to equipment malfunction or misuse. The actual risks depend on the activity and my individual condition.
I understand that scan results and movement assessments are estimates and may be affected by positioning, movement, equipment, or software.
3. Health and safety responsibility
I am responsible for deciding whether I can safely participate. I will not begin or continue an activity if I feel dizzy, ill, in pain, unsteady, or otherwise unsafe. I will stop and seek appropriate assistance if a concern arises.
Accurate Athlete does not provide medical diagnosis, treatment, physical therapy, emergency medical services, or a substitute for advice from a licensed health professional. I should consult a qualified health professional about medical concerns before participating.
4. Instructions and minors
I will follow posted safety instructions and digital guidance, use scanning equipment only as instructed, and report a problem through the contact method provided by Accurate Athlete.
A minor may use the studio or a service only when Accurate Athlete has approved the visit and the minor is accompanied by a parent or legal guardian. A parent or guardian is responsible for supervising the minor and reviewing applicable service-provider age requirements. Some scanning services may have additional age restrictions.
5. Assumption of risk and limited release
I knowingly assume the ordinary and reasonably foreseeable risks that are inherent in my voluntary participation, including the risks described above.
To the fullest extent permitted by applicable law, I release Accurate Athlete, LLC and its owners, employees, contractors, and representatives from claims for ordinary negligence directly arising from those inherent participation risks. This release does not apply to gross negligence, reckless or intentional misconduct, or any claim or right that applicable law does not allow me to waive.
6. Limited responsibility for third-party claims
To the extent permitted by law, I agree to be responsible for a third-party claim to the extent it is directly caused by my intentional misconduct or material violation of a safety rule. I am not responsible under this section for a claim to the extent it is caused by Accurate Athlete’s conduct or by a condition for which I am not responsible.
7. Scan information and privacy
A body or movement assessment may involve measurements, posture or movement information, timestamps, and scan imagery or recordings. Accurate Athlete’s Privacy Policy describes how this information is collected and handled and identifies the service providers used for these assessments.
This waiver does not replace the Privacy Policy or waive privacy rights that cannot be waived by law.
8. No guaranteed results
Accurate Athlete does not guarantee a particular fitness result, injury prevention, a specific level of scan accuracy, or uninterrupted availability of equipment or technology. An assessment is informational and is not a diagnosis.
9. Governing law and severability
This agreement is intended to be governed by Washington law, subject to any mandatory law that applies. If a provision is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
Membership Agreement
Membership access, billing, cancellation, safety, and service terms for Accurate Athlete, LLC.
1. Membership plans and fees
Accurate Athlete may offer monthly or annual recurring memberships, scan- or session-based packages, and pay-per-use services. The price, billing cycle, included services, and any plan-specific limits are shown when you purchase. The purchase details for your plan control if they differ from this general description.
2. Billing and price changes
When you enroll in a recurring membership, you authorize Accurate Athlete or its payment provider to charge the payment method you provide on each billing date until you cancel under Section 5. You are responsible for keeping payment details current. Access may be suspended for an unpaid balance.
Accurate Athlete will provide at least 30 days’ notice of a membership price change. The new price applies on the date stated in the notice.
3. Access and member responsibilities
A membership provides nonexclusive, revocable access to the services included in the purchased plan, which may include the unmanned studio, Styku body scans, Demotu movement assessments, and related digital services. Access is subject to studio hours, safety instructions, availability, and these terms.
You agree to use access credentials only for yourself, not to let an unauthorized guest enter, follow posted instructions, avoid tampering with equipment, and report damage or a malfunction. You are responsible for damage directly caused by your misuse or intentional conduct.
4. Health, safety, and minors
The studio is unmanned and does not have continuously present on-site staff or medical personnel. You are responsible for deciding whether an activity is safe for you and for stopping if you feel unwell or unsafe. The services do not provide medical diagnosis or treatment.
A minor may use the studio or a service only when Accurate Athlete has approved the visit and the minor is accompanied by a parent or legal guardian. The parent or guardian must supervise the minor and check any additional age or consent rules that apply to a third-party scan service.
5. Cancellation and refunds
You may request cancellation by sending a written request to support@accurateathlete.com or by using the designated cancellation option in your member account portal. Unless the plan says otherwise, cancellation takes effect at the end of the current billing cycle; charges due before that date remain payable.
Unless a posted refund policy or the law requires otherwise, membership fees are nonrefundable. Unused sessions or scans do not roll over unless the purchased plan expressly says they do. No refund is issued for access terminated because of a violation of these terms, except where required by law.
6. Scan services and personal information
Using scan services requires the collection and processing of assessment information described in the Privacy Policy. You may withdraw consent where applicable, but doing so may make a scan service unavailable. The Privacy Policy identifies Styku, Demotu, Stripe, the member portal, and other relevant providers.
7. Suspension or termination
Accurate Athlete may restrict or terminate access for nonpayment, unsafe or disruptive conduct, misuse of access credentials, damage to property, or a material violation of this agreement or posted safety rules. Where practical, Accurate Athlete will explain the reason and provide a way to contact support.
8. Changes, governing law, and entire agreement
Accurate Athlete may update this agreement and will update the posted version and effective date. Material changes may be communicated by email or through the member portal. Continued use after a change takes effect may constitute acceptance where permitted by law.
Washington law governs this agreement, subject to mandatory law that applies. This agreement, the Terms of Service, the Privacy Policy, the applicable purchase details, and any separately accepted waiver describe the membership relationship. If a provision is unenforceable, the remaining provisions remain in effect to the extent permitted by law.

Nothing in these Terms limits liability that cannot legally be limited, including liability for gross negligence, reckless or intentional misconduct, or other non-waivable rights. To the extent permitted by law, you are responsible for third-party claims directly caused by your intentional misconduct or material violation of these Terms, excluding the portion caused by Accurate Athlete.
11. Governing law, severability, and contact
Washington law governs these Terms, subject to mandatory law that applies. If a provision is unenforceable, the remaining provisions remain in effect to the extent permitted by law.
